Gayle Queen and Donald J. Freeman, individually and on behalf of others similarly situated v. Constellation Power Source Generation, Inc.

A group of Gambrills residents banned together to fight the power giant, Constellation Energy, for polluting their air and drinking water with chemicals such as lead, arsenic and beryllium known to cause cancer and other serious health problems.

Murphy PA filed the class action against Constellation Power Source Generation, Inc. in November 2007 stating that they knowingly dumped fly ash, a by-product of coal burning in power plants, into craters in a sand and gravel mine which led to the poisoned groundwater and air quality threatening the health and safety of the residents of Gambrills. 

The health, welfare and ultimate lives of residents throughout the Gambrills area forced to breathe and drink the contaminated elements due to the carelessness of the energy giant.  Their homes and their peace of mind. On December 30, 2008, Baltimore City Circuit Court Judge Alfred Nance approved a settlement agreement between plaintiffs and the electric company that provides, among other items, public water for households, $9.5 million to pay for property and health issues and $500,000.00 for community beautification projects, all at Constellation’s expense.  The settlement affects residents from Summerfield, Queen Mitchell and Evergreen roads and the Chapel Gate Condominiums.
